Mining exploration equipment designer and manufacturer
Patent infringement proceedings
We successfully acted for a large designer and manufacturer of mining exploration equipment in connection with patent infringement proceedings. The plaintiff alleged infringement of a patent for a core orientation tool used in exploration drilling. Our client defended the claim and brought a cross claim seeking revocation of the patent. The proceedings were effectively settled on confidential terms and orders.
Mulitnational mining investment house
We managed a successful European opposition to a patent concerning nickel laterite leaching on behalf of a subsidiary of a significant multinational mining investment house. Our input received favourable EPO Opposition Division feedback.
This project involved locating relevant prior art and preparing the opposition case with the assistance of a European associate. We also worked on the corresponding Australian case where the applicant withdrew the application before the opposition hearing.
Drilling and exploration technologies
Patent application through to registration
We productively managed a patent portfolio for a client active in the fields of drilling telemetry, surveying and core sampling. This work included original drafting of patent applications, prosecution, registration and handling third party disputes. We interacted with the Deep Exploration Technologies CRC based in Adelaide and university-based research on related projects.
