Review calls for submissions from franchising sector by 15 February 2013


A review of the Franchising Code of Conduct (“the Franchising Code”) was announced on 4 January 2013 by the Minister for Small Business, Brendan O’Connor.

The review will be conducted by Alan Wein, and will inquire into the efficacy of the implementation of amendments made to the Franchising Code in 2008 and 2010, and into issues such as:

  • good faith in franchising;
  • the rights of franchisees at the end of their franchise agreements, including recognition for any contribution they have made to building the franchise; and
  • how provisions of the Competition and Consumer Act 2010 operate to enforce the Franchising Code.

As part of the review process, consultations will be conducted with industry and interested State and Territory stakeholders, and submissions from the franchising sector are invited by 15 February 2013.

A final report detailing the reviewer’s findings and recommendations is due for public release within three months of the commencement of the review.
